General Terms and Conditions NiumeYoga
1. Identity of the entrepreneur
1.1. Name of the entrepreneur: Niume
1.2. Operating under the trade name Niume Yoga (the Seller)
1.3. Our registration address is Stapelwolk 20, in Elst (Gld.), The Netherlands (no visiting address). We can be contacted via our email address hello@niumeyoga.com
1.4. Niume is a webshop registered in the Dutch trade register, Chamber of Commerce no. 80476627
1.5. Our VAT ID is NL003445030B77
2. Applicability
2.1. These general terms and conditions apply to all transactions between Niume Yoga (the Seller) and our customers (the Buyer), regardless of how these transactions came into effect
3. Our offering
3.1. We sell Yoga mats and related items with an ecological perspective
3.2. We primarily sell our products to private individuals, but we also accept orders to companies
3.3. The description of our products and the product features can be found on our website https://niumeyoga.com
3.4. Obvious mistakes or errors in the offering are not legally binding for Niume
4. The agreement
4.1. The agreement is concluded at the time of acceptance of the offer and the terms and conditions applicable at that time
4.2. With every purchase we confirm the complete order including delivery costs, insofar as known to us prior to delivery
5. Reflection time
5.1. Every private customer has a legal reflection period of 14 days, after which only the costs of the purchased product will be returned, provided that the returned product is received by us in ‘as new‘ condition.
5.2. During the reflection period, the Buyer will handle the product and packaging with care. He will only unpack or use the product to the extent necessary to determine the nature, characteristics and operation of the product. The basic principle here is that the consumer may only handle and inspect the product as he would be allowed to do in a physical store
5.3. If the Buyer changes his mind and returns the products following the return policy as published on our website, he will return the product and all complementary accessories supplied
5.4. The costs for the return shipment are for the Buyer
6. Delivery
6.1. We deliver the products to our customers (the Buyer) by using national and international transport companies, typically courier companies
6.2. We deliver all orders to the address specified by the customer, provided that this address is easily accessible for the designated carrier.
6.3. The costs for delivery depend on the shipment size and destination and will be charged separately to the Buyer.
6.4. Additional costs for delivery, such as taxes and import duties, are always at the expense of the Buyer
6.5. We bear the risk of loss or damage until the ordered products have been delivered to the address specified by the customer.
6.6. Until delivery, Niume remains the owner of the ordered goods
7. Complaint handling
7.1. We only accept written complaints that have been sent to us as soon as possible after receipt of the goods but no later than 1 month after shipment and exclusively by email. We can only handle complaints if it is stated by whom the complaint was submitted by and his / her address details, as well as the order number of the original delivery
7.2. We will answer customers as soon as possible, but no later than 15 working days
8. Payment and Guarantee
8.1. Customers can pay with us in various ways, but always via the payment services designated by us as listed on our website https://niumeyoga.com
8.2. Warranty provision: we apply the legal warranty provisions
8.3. Customers pay for their order immediately after placing the order. In general, a payment term of 14 days after the invoice date applies. The invoice is created after the order has been placed, so the order date is therefore also the invoice date.
8.4. If an invoice has not been paid within the set payment term and Niume can demonstrate that the goods have been delivered, we will charge 40 Euro of late payment costs and we can contract a collection agency after one written payment reminder to cash the overdue invoiced amount
8.5. If collection costs arise for the collection of invoices, these are at all times for the account of the Buyer
9. Other provisions
9.1. Our Privacy Statement states how we handle personal data, respecting the applicable European General Data Protection Regulation (GDPR)
9.2. We make no distinction in terms of sale for customers in the different countries of the European Union (so no geo-blocking)
9.3. Dutch law is applicable at all times for all sales conditions and for the settlement of disputes
9.4. We are not responsible for consequential damages or losses due to the use of our products
